Rental Contract Terms
Rental Contract Specifications
This contract states that you agree to pay the rental payment while the instrument is in your possession.
Rental Account Holder must be 21 years of age.
The contract is between the account holder and Upper Mitten Music Service only. The student’s school, teachers, or other individuals are not responsible for any terms or agreements in this contract.
Upper Mitten Music Service currently offers rentals to customers within Grand Traverse and Kalkaska counties. We reserve the right to make exceptions to this service area on an individual basis, but are unable to rent outside of our immediate local area.
All rental payments are to be processed as automatic recurring monthly payments charged to a credit or debit card. No physical copies of payment card information will be retained; payment card information will be saved in our secure QuickBooks online accounting platform. Rental payments will automatically be charged to saved payment cards on the 1st of the month.
Monthly payments are subject to a $5.00 late fee after the 15th of the month.

Your first payment will be processed on the date your contract is processed. Your second rental payment (first scheduled automatic recurring payment) will be processed on the next 1st of the month at least 21 days after the first payment. For example:
If your first payment is processed on the 18th of September, your second payment will not be processed until the 1st of November (skipping October 1)
If your first payment is processed on the 6th of September, your second payment will be processed on the 1st of October
Your contract is not valid until the first payment has been received.
Statement of Ownership: Upper Mitten Music Service maintains all of the rights of a secured party during the term of this agreement. The instrument listed in this agreement remains the sole property of Upper Mitten Music Service until such time as payments made equal the total purchase price listed on this agreement. A claim of ownership may only be made after Upper Mitten Music Service has received payment in full according to the terms of this agreement. No claim of ownership will apply until your payments have equaled the total purchase price as listed in this agreement.
We will cover repairs as needed to keep your instrument in excellent playing condition during the term of the rental contract. All service must be performed by Upper Mitten Music Service
Fire or Theft: In the event of loss, fire, or theft the lessee shall file a police report and furnish it to Upper Mitten Music Service within 48 hours of the occurrence. At that time Upper Mitten Music Service may replace the instrument with one of equal value. In the event that the lost instrument should be found/recovered, the replacement instrument must be returned to Upper Mitten Music Service immediately.
Loss: If the instrument should be lost or lost by fire or theft, and no police report is received, Upper Mitten Music Service has no duty to replace it and the renter will be completely responsible for the remaining balance owed for the instrument as set forth in this agreement.
Do not leave your rental instrument unattended in unsecure areas.
Delinquent Accounts
First - if your family is experiencing financial hardship that impacts your ability to continue making your rental payments, please contact us. We will work with you (and any other party we’re able to, such as your child’s band director or community organizations) to ensure that your child has access to an instrument to participate in their school band program.
If your account becomes more than 3 months delinquent, Upper Mitten Music Service reserves the right to proceed with any of the following:
Void accrued credit per Upper Mitten Music Service’s discretion.
Charge the credit card you provided for the total amount past due.
Pick up the instrument from school or home.
Turn your account information over to our collection agency.
Repairs, exchanges, and upgrades will not be processed if the account is past due
Please take note that you will be responsible for all repairs if the instrument is damaged while the account is not in good standing.
Purchase & Rental Credit Details:
100% of your rental payment applies as credit towards the purchase of your rental instrument
Sales tax applies to all instrument rentals, and is remitted by Upper Mitten Music Service to the State of Michigan; sales tax paid does not apply to the price of the instrument
Instrument is considered paid off when the total of rental credit equals the full rental price of the instrument.
An instrument with a price of $1,000 is subject to $60 (6%) sales tax. The instrument will be paid off when the total paid with sales tax reaches $1,060.
Accrued rental credit and sales tax paid are non-refundable when the contract is terminated.
Credit is specific to the student renting on this contract and can not be transferred to another student. Credit is VOID once the rental instrument is returned and rental account is terminated.
Instrument exchanges: rental credit (accrued rental payments) may be applied to instrument exchanges for the same student. If a student starts on clarinet, and switches to trombone, the rent paid toward the clarinet will be applied to the rental of the trombone.
A 20% early payoff discount may be applied to the remaining balance at any time while the rental account is active.
Maintenance and repairs are covered free of charge on the instrument and case.
Accessories such as mouthpieces, ligatures, reeds, neckstraps, books, cleaning & care products, etc. are NOT covered.
Mouthpieces and ligatures
Replacement accessories may be supplied at applicable replacement cost.
In the event that a rental instrument is returned with any original reusable accessories (mouthpiece, ligature) missing, or with replacement items of inferior quality, Upper Mitten Music Service reserves the right to charge the renter for the replacement price of the missing items.
Malicious damage
Malicious damage is not covered. Malicious damage includes but is NOT limited to: carving in the instrument, neglectful damage, etc.
“Malicious damage” is subject to the sole discretion of Upper Mitten Music Service.
Upper Mitten Music Service, LLC reserves the right to request payment for the full retail value of the instrument if damage is found to be malicious.
In the event of damage deemed to be malicious, Upper Mitten Music Service reserves the right to:
Cancel the rental account
Void accrued rental credit
Request payment for the full value of the damaged rental instrument, with no discount applied for existing rental credit that has been voided
Canceling:
You can cancel your instrument rental at any time. Steps to cancel your account and return the instrument to Upper Mitten Music Service are below. Please follow steps 1-3 to prevent additional rental payment charges beyond the date you wish to cancel your rental:
1.) Fill out a cancellation/return instrument form from our website - here
2.) Contact us to inform us that the instrument is being returned:

3.) Return the instrument by either:
dropping the instrument off at Traverse City Violin Co (3003 Garfield Rd, TC), and informing us that you have done so, OR
informing your child’s band director that you’re returning your rental instrument to us (parents - please do this yourselves so your middle schooler doesn’t forget!), and have your student leave the instrument with the band director so that we can pick it up from the school.
Once you have notified us that you wish to cancel your rental account, we will pause your payments. Once the instrument has been returned to us, we will cancel your rental account. If you notify us that you wish to cancel the account, but fail to return the instrument, rental payments will continue to be charged until the instrument is returned.
In the event that the renter wishes to cancel their rental account and return their instrument, but fails to notify Upper Mitten Music Service of this change, no charged rental payments will be refunded
